The apprehension of Ignace Murwanashyaka by the German authorities, and the arrest by Ugandan authorities of some leaders of the Mouvement révolutionnaire congolais on its territory, notably Bwambale Kakolele who had close affiliations with FDLR, seems to have further splintered the FDLR command structure in the Democratic Republic of the Congo.
On 31 March, in Rome, the President of FDLR, Ignace Murwanashyaka, announced that FDLR had decided to renounce violence and denounce the Rwandan genocide and was prepared to join the disarmament, demobilization, repatriation, reintegration and rehabilitation process.
On 17 November, in a major step forward in severing links with the leadership of the group, the German Federal Police arrested Ignace Murwanashyaka, President of FDLR, and his deputy Straton Musoni in Germany on charges of membership in a foreign terrorist organization and for war crimes and crimes against humanity committed in eastern Democratic Republic of the Congo.
The Group has also learned from interviews with ex-combatants that the arrests in Germany of FDLR President and Vice-President Ignace Murwanashyaka and Straton Musoni have helped to exacerbate pre-existing rivalries and may have increased friction between factions at the senior level within FDLR.

In a major development, on 17 November 2009, the German Federal Police arrested Ignace Murwanashyaka, the president of FDLR, and his deputy, Straton Musoni, in Germany on charges of membership in a foreign terrorist organization and for war crimes and crimes against humanity committed in the eastern Democratic Republic of the Congo.
The main judicial activities in 2000 have been the judgement and sentence to life imprisonment of Alfred Musema on 27 January 2000; the trial of Ignace Bagilishema; the rendering of interlocutory appeal decisions in the cases of Jean Bosco Barayagwiza and Laurent Semanza, and the guilty plea and sentencing of Georges Ruggiu.
This conclusion has been drawn from direct testimonies, including testimonies of demobilized FDLR elements, who have consistently reported that Ignace Murwanashyaka was in direct contact with the FDLR military leadership on the ground.
On 17 December, German prosecutors announced that FDLR President Ignace Murwanashyaka and his deputy, Straton Musoni, who were arrested in November 2009, had been indicted on charges of crimes against humanity and war crimes allegedly committed in the eastern Democratic Republic of the Congo between January 2008 and July 2009.
Although no large-scale repatriation followed the declaration made by the President of FDLR, Ignace Murwanashyaka, in Rome on 31 March 2005, it had the apparent effect of encouraging some officers and combatants to defy their superiors, who still opposed the disarmament, demobilization, repatriation, resettlement and reintegration process, and seek to enter the process.
An FDLR former combatant who managed Lieutenant Colonel Nsanzubukire's communications devices declared to the Group in late April 2009 that FDLR president Ignace Murwanashyaka had been in frequent and direct contact with Colonel Nsanzubukire in 2009, and that Mr. Murwanashyaka instructed him to use all necessary ammunition against the Kimia II operations as further deliveries were expected from outside the Democratic Republic of the Congo.
According to ex-combatants interviewed by the Group, direct international support to FDLR through diaspora members has dramatically decreased since the arrests by the German authorities of former FDLR President Ignace Murwanashyaka and former Vice-President Straton Musoni in November 2009, together with the arrest of the FDLR executive secretary, Callixte Mbarushimana, by French authorities in October 2010.

The Group obtained from an FDLR active element a document stamped with an FDLR seal which clearly indicates that the FDLR political leaders in the diaspora also function as military officials(see excerpts in annex 16). In particular, Ignace Murwanashyaka, the Germany-based president of FDLR, is cited as the supreme commander of the FDLR armed forces.
