The present document contains the tenth report on evaluation since the Central Evaluation Office(CEO) was established in 1983 in order to provide UNDP and the Governing Council with independent and objective judgements on" the effectiveness and impact of the Programme, the reasons for its successes and failures, and the lessons that can be drawn to improve performance in the future"(DP/1983/ICW/6, para. 61).

Among the three cases that the Prosecutor ' s Office has filed relating to the situation in Darfur, the only positive element that we can take from the tenth report is the voluntary appearance before the Court in May and October 2009 of the rebel leader Bahr Idriss Abu Garda, suspected of war crimes in the attack against the African Union base in Haskanita.

The tenth report, referring to the serious riots at the San Francisco Gotera, Santa Ana and Sensuntepeque detention centres, pointed out, that" those serious incidents, as well as the tense situation prevailing in those and in other detention centres in the country, demonstrate that the situation in the prisons of El Salvador is critical and calls for action by the State to solve the structural problems in the prison system"(A/49/116-S/1994/385, para. 105).

Although time had not permitted the Commission to consider the Special Rapporteur ' s tenth report(A/CN.4/459), it dealt with interesting and important aspects of the topic of international liability, such as prevention ex post, the relationship between State liability and civil liability, specific issues in the field of civil liability and the question of procedural channels to enforce liability.

Residual State liability was essential and, accordingly, his delegation strongly favoured alternative A under article 21. There might even be another possibility, similar to option C in paragraph 26 of the Special Rapporteur ' s tenth report(A/CN.459) wherein the State in which the incident occurred would be liable for any residual damage not compensated by the operator, regardless of whether there was fault on the part of the State.

Accordingly, it submitted its initial report(combining the second, third, fourth, fifth, sixth and seventh periodic reports) in 2002 and its second periodic report(combining the eighth, ninth and tenth reports) in 2007. The second report ' s presentation to the forty-fifth session of the African Commission on Human and Peoples ' Rights is scheduled for 11-25 November 2009.
