ILO Convention No. 182(1999) concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour, in all sectors, including in agriculture, domestic service, family farms and businesses.

The Convention on the Rights of the Child, ILO Convention No. 169 concerning Indigenous and Tribal Peoples in Independent Countries and ILO Convention No. 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour, as well as other relevant instruments, constitute the normative foundation on which policies and programmes on indigenous children and youth should be based.

The provision emphasizes education as means of empowerment of indigenous children, reaffirming already existing international standards, in particular the standards adopted by ILO, including the Conventions concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour(Convention No. 182), the Minimum Age for Admission to Employment(Convention No. 138) and Indigenous and Tribal Peoples in Independent Countries(Convention No. 169).

A Law of the Child Act, currently awaiting second reading in Parliament, would harmonize national legislation with international instruments ratified by her country, including the Convention on the Rights of the Child and its two Optional Protocols, the African Charter on the Rights and Welfare of the Child and International Labour Organization Convention No. 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour.

At the international level, Syria has acceded to the two Optional Protocols to the Convention on the Rights of the Child and to ILO Convention No. 138 concerning Minimum Age for Admission to Employment. The employment age in Syria has been raised to 15 years. Syria has also acceded to ILO Convention No. 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour.

The Committee calls on the State party to ensure that children are protected from social and economic exploitation, including by bringing its legislation fully into conformity with International Labour Organization(ILO) standards on minimum age of employment and the regulation of employment of children in hazardous conditions, in compliance with ILO Convention No. 182(1999) concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour.

تطلب اللجنة إلى الدولة الطرف أن تضمن حماية الأطفال من الاستغلال الاجتماعي والاقتصادي، بوسائل تشمل مواءمة تشريعاتها بالكامل مع معايير منظمة العمل الدولية المتعلقة بالحد الأدنى لسن العمل وتنظيم عمل الأطفال في ظروف خطيرة، بموجب اتفاقية منظمة العمل الدولية رقم 182 لعام 1999 المتعلقة بحظر أسوأ أشكال عمل الأطفال واتخاذ الإجراءات الفورية للقضاء عليها

The Committee is also of the view that the“Diligent Work and Economical Study”(qingong jianxue) programme for schoolchildren constitutes exploitative child labour, in contradiction of the provisions of articles 6 and 7 of the Covenant, and Convention No. 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour of the International Labour Organization(ILO) to which China is a party.

كما ترى اللجنة أن تطبيق برنامج"استقطاع وقت من الدراسة للعمل الدَؤُوب" على طلاب المدارس يشكل نوعا من عمل الأطفال الذي ينطوي على استغلال، ويتعارض ذلك مع أحكام المادتين 6 و7 من العهد، واتفاقية منظمة العمل الدولية رقم 182 بشأن حظر أسوأ أشكال عمل الأطفال واتخاذ الإجراءات الفورية للقضاء عليها، اللذين هما صكان تعدّ الصين طرفاً فيهما

The Committee also expresses its appreciation to the State party for having ratified ILO Convention No. 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour of 1999, the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights of 1966, and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment of 1984.

كذلك تعرب اللجنة عن تقديرها للدولة الطرف لتصديقها على اتفاقية منظمة العمل الدولية رقم 182 الصادرة عام 1999، بشأن حظر أسوأ أشكال عمل الأطفال والإجراءات الفورية للقضاء عليها، وعلى العهد الدولي الخاص بالحقوق المدنية والسياسية، والعهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية الصادر عام 1966، واتفاقية عام 1984 لمناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة
