For the first time, it had heard the reports of the Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence, the Independent Expert on the promotion of a democratic and equitable international order, the Working Group on the issue of human rights and transnational corporations and other business enterprises, and the Working Group on discrimination against women in law and in practice.
He also noted the importance of ongoing collaboration between the Working Group on the issue of human rights and transitional corporations and other business enterprises, the Special Rapporteur on the rights of indigenous peoples, the Permanent Forum on Indigenous Issues and the Expert Mechanism to promote the effective implementation of the Declaration on the Rights of Indigenous peoples in relation to the Guiding Principles on Business and Human Rights(A/HRC/17/31, annex).
In its resolution 20/4, the Human Rights Council invited the Office of the United Nations High Commissioner for Human Rights(OHCHR) to prepare, in consultation with the Office of the United Nations High Commissioner for Refugees(UNHCR), the Working Group on the issue of discrimination against women in law and in practice, States and other relevant stakeholders, a report on discrimination against women in nationality-related matters.
In this regard, the Working Group on the issue of discrimination against women in law and in practice observed in its 2013 report that"[t]he use of quotas to advance women ' s political representation and participation has increased in the past three decades and produced significant results when properly adapted to specific electoral and political systems"(A/HRC/23/50, para. 38).
Furthermore, the Special Rapporteur on the rights of indigenous peoples(A/HRC/24/41/Add.4), the Special Rapporteur on the situation of human rights defenders(A/HRC/25/55/Add.3) and the Working Group on the issue of human rights and transnational corporations and other business enterprises(A/HRC/23/32) also received reports of harassment, persecution, reprisals against, stigmatization and killings of indigenous human rights defenders.
In December 2013, it hosted a visit by Puvan Selvanathan, a member of the Working Group on the issue of human rights and transnational corporations and other business enterprises, during which OHCHR co-organized a training session on business and human rights with the Cambodia Human Rights Committee, in which nine Government ministries and the Council for the Development of Cambodia participated.
Expert Mechanism to continue its work on indigenous peoples and the right to participate in decision-making, with a focus on extractive industries, in cooperation with the thematic work of the Special Rapporteur on the rights of indigenous peoples, and to communicate and to share knowledge and good practices with the Working Group on the issue of human rights and transnational corporations and other business enterprises.
UN-Women provided technical and other support to the Committee in its work on elaborating general recommendations; continued to collaborate with the working group on the issue of discrimination against women in law and practice, including on its thematic priorities and country missions; and cooperated with other mechanisms of the Human Rights Council, including the Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence, who was appointed in 2012.
In its first thematic report(A/HRC/23/50), the Working Group on the issue of discrimination against women in law and in practice noted that indigenous women and girls, among other marginalized groups, faced discriminatory practices in several areas, in particular in the implementation of laws on nationality and citizenship, which limit access to formal registration of births, marriage, residence and other citizenship documents as well as to relevant information on their rights as citizens.
Discussions were marred by the walkout of the participants from the proxy regimes of Tskhinvali and Sokhumi from the Working Group on the Issues related to the Safe and Dignified return of the Internally Displaced Persons and Refugees.
Support was expressed for the view that because recommendation 3 was a rule of a substantive nature rather than a rule of applicable law, and bearing in mind the discussion in the Working Group on the issues of set-off and netting, it should be deleted.
