Mr. Joyini(South Africa), Chair of the Working Group, recalled that, pursuant to General Assembly resolution 65/27, the Committee had decided to establish a working group to examine further the question of a convention on diplomatic protection, or any other appropriate action, on the basis of the articles on diplomatic protection and also to identify any difference of opinion on the articles. .

Pursuant to General Assembly resolution 65/19 of 6 December 2010, the Committee established a Working Group on the responsibility of States for internationally wrongful acts, in order to further examine, with a view to taking a decision, the question of a convention on the responsibility of States for internationally wrongful acts or other appropriate action on the basis of the articles on the responsibility of States for internationally wrongful acts.
Pursuant to resolution 62/61, the Committee decided, at its 1st meeting, on 4 October 2010, to establish a Working Group on the Responsibility of States for Internationally Wrongful Acts, in order to fulfil the mandate conferred by the General Assembly on the Committee, namely, to further examine the question of a convention on the topic or other appropriate action on the basis of the articles drafted by the International Law Commission.

A general exchange of views had been held on the possibility of negotiating an international convention on the basis of the articles on responsibility of States for internationally wrongful acts.
El Salvador was in favour of joint efforts by States to negotiate a convention in the field of diplomatic protection on the basis of the articles developed by the International Law Commission.
Four possible options had been identified: to defer once again the decision on the future of the articles on State responsibility to a future session; simply to conclude the General Assembly ' s consideration of the fate of the articles; to conclude consideration of the fate of the articles for the time being, while leaving open the possibility of returning to the matter in the future; or to recommend the negotiation of an international convention on the basis of the articles.
