Most of the  changes to the draft articles had been introduced as a result of suggestions formulated by States.
In the  light of that Act, his delegation had several concerns with regard to the draft articles.

Japan is in favour of placing the article  in Part One, Chapter I"[a]s article  39 is related to the draft articles as a whole".
On the  other hand, articles  37 and 39 express principles or provisos that are applicable to the draft articles as a whole.
Several Governments have noted that article  37, in particular, should be made applicable to the draft articles as a whole.
In this connection, far be it from the  Special Rapporteur to  prejudge the  form that the  General Assembly would want to  give to the draft articles.
General support was expressed for the  retention of draft article  3 which was considered central to the draft articles.
