The Committee particularly recommends that the State party ensure that the sale of children is defined in its legislation explicitly and in accordance with the provision on sale contained in the Protocol and that all elements of the Protocol, including the sale of children for forced labour and the transfer of organs for profit, are prohibited.

Brazil made reference to offences against children established in its legislation, which encompassed some of the means of trafficking stipulated in the definition contained in the Protocol as forms of the basic criminal conduct, such as abduction of minors and adolescents, sale of children or pupils(“through the giving and receiving of payment”) and abuse of power against minors and adolescents.

These protection measures should also be consistent with the provisions contained in the Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children, including providing legal representation, witness protection, the rehabilitation of victims, opportunities for rehabilitation or for staying in the country of destination and efforts to combat the root causes of trafficking in countries of origin, especially through the economic empowerment of women;

The Committee welcomes that the Hungarian Penal Code has applied the definition of trafficking as contained in the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime(2000), however it regrets that ratification of the abovementioned Protocol still remains pending since its signature on 14 December 2000.

Moreover, even though Croatia firmly believes that the prime responsibility for clearing explosive remnants of war lies with the country that deployed those weapons, we also accept the solution contained in the protocol whereby the country that deployed the explosive ordnance would cooperate closely with the country in control of the contaminated territory in eventual clearance operations.
