As to the author ' s claim that convicted and unconvicted prisoners are not segregated in Port Philip Prison, the Committee notes that the State party has invoked its reservation to article 10, paragraph 2(a), of the Covenant which states that," In relation to paragraph 2(a)

In the context of the Secretary-General ' s in-depth study on the question of violence against children, while the Committee acknowledges with appreciation the State party ' s participation in the Regional Consultation for Europe and Central Asia, held in Slovenia from 5 to 7 July 2005, it notes that the State party has not responded to the related questionnaire.

While welcoming the significant changes made by the State party with regard to the regulation of parental relations, in particular a major trend towards establishing joint parental custody of their children, the Committee notes that the State party is still using the term" custody" in its legislation, and not" parental responsibility" as used in the Convention and in some of the international instruments adopted after the entry into force of the Convention on the Rights of the Child.
