Bearing in mind further the Basic Principles on the Role of Lawyers, in particular principle 1, which states that all persons are entitled to call upon the assistance of a lawyer of their choice to protect and establish their rights and to defend them in all stages of criminal proceedings.

ونظراً إلى غياب أي إجراءات قانونية، ناهيك عن المحاكمة العادلة، يتعارض احتجاز السيد القحطاني أيضاً مع المادة 10 من الإعلان العالمي لحقوق الإنسان، والمبدأ 1 من المبادئ الأساسية المتعلقة بدور المحامين، والمبدأ 18 من مجموعة وينص المبدأ ٨ من المبادئ اﻷساسية بشأن دور المحامين على أن" توفر لجميع المقبوض عليهم أو المحتجزين أو المسجونين فرص وأوقات وتسهيﻻت تكفي ﻷن يزورهم محام ويتحدثوا معه ويستشيروه، دونما إبطاء وﻻ تدخل وﻻ مراقبة وبسرية كاملةThe Basic Principles on the Role of Lawyers establish that all persons should have effective and equal access to lawyers, and call on Governments to" ensure the provision of sufficient funding and other resources for legal services to the poor and, as necessary, to other disadvantaged persons".
وتؤكد المبادئ الأساسية بشأن دور المحامين حق جميع الأشخاص في الوصول إلى المحامين بصورة فعالة وعلى قدم المساواة، وتدعو الحكومات إلى" ضمان توفير التمويل الكافي والموارد الأخرى من أجل تقديم الخدمات القانونية للفقراء، وإلى غيرهم من الفئات الضعيفة، عند الاقتضاء"(Given the absence of any legal procedure, let alone fair trial, Mr. Al-Ghamdi ' s detention also runs contrary to article 10 of the Universal Declaration of Human Rights, Principle 1 of the Basic Principles on the Role of Lawyers and Principle 18 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
ونظراً إلى غياب أي إجراءات قانونية، ناهيك عن المحاكمة العادلة، يتعارض احتجاز السيد الغامدي أيضاً مع المادة 10 من الإعلان العالمي لحقوق الإنسان، والمبدأ 1 من المبادئ الأساسية المتعلقة بدور المحامين، والمبدأ 18 من مجموعة (c) Mr. Gusmao ' s freedom to choose his lawyer, which is one of the essential guarantees of the right to a fair trial, was violated under conditions so serious as to cast doubt on the fairness of the entire trial, infringing articles 1, 13 and 15 of the Basic Principles on the Role of Lawyers.
(ج) انتهكت حرية السيد غسماو في اختيار محاميه بنفسه، التي هي إحدى الضمانات أما الإشعار الذي أصدره مكتب العدل في بيجينغ في 29 تموز/يوليه 1999 فيما يتصل بقضايا طائفة فالون غونغ فيمكن اعتباره خرقاً للمبدأ 16 من المبادئ الأساسية بشأن دور المحامين إذ أنه يشكل تدخلاً غير لائق في أداء وظائف المحامينيدرك المقرر الخاص أن الحكومات تنظر أحيانا إلى دور المحامين ونقاباتهم في الدفاع عن حقوق اﻹنسان والحريات اﻷساسية، على النحو المنصوص عليه في الفقرة ٤١ من المبادئ اﻷساسية لدور المحامين، كتدخل من المحامين في السياسةas well as paragraph 8 of the Basic Principles on the Role of Lawyers.
