BY THE PROCURING ENTITY in Arabic translation

When any of the grounds in the procurement regulations or other provisions of law is invoked by the procuring entity as a justification for restricting participation in procurement proceedings, paragraph(3) requires the procuring entity to make declaration to such effect at the outset of the procurement proceedings.

وعندما تتذرّع الجهة المشترية بأيٍّ من الأسباب الواردة في لوائح الاشتراء التنظيمية أو الأحكام القانونية الأخرى كمسوّغ لتقييد المشاركة في إجراءات الاشتراء، فإنَّ الفقرة(3) تقتضي أن تصدر الجهة المشترية إعلانا بذلك في بداية إجراءات الاشتراء

The purpose of the article is to prevent manipulation by the procuring entity in estimation of the value of procurement by artificially reducing the value of procurement for the purpose of limiting competition and avoiding other obligations under the Model Law.

الغرض من هذه المادة هو منع تلاعب الجهة المشترية في تقدير قيمة الاشتراء من خلال التخفيض المصطنع لقيمة الشراء بغرض الحدّ من التنافس وتجنّب التزامات أخرى ينصّ عليها القانون النموذجي

(d) In procurement proceedings in which the procuring entity, in accordance with article 8 of this Law, limits the participation of suppliers or contractors, a statement of the reasons and circumstances relied upon by the procuring entity for imposing such a limit;

(د) في إجراءات الاشتراء التي تحدّ فيها الجهة المشترية، وفقاً للمادة 8 من هذا القانون، من مشاركة المورِّدين أو المقاولين، بياناً بالأسباب والظروف التي استندت إليها الجهة المشترية في فرض ذلك الحد

(c) To clarify in the penultimate sentence of paragraph 24 that the sentence was intended to address a situation in which there was a system failure prior to the receipt of a tender by the procuring entity.

(ج) أن يوضَّح في الجملة قبل الأخيرة من الفقرة 24 أنَّ القصد من تلك الجملة هو معالجة حالة وقوع عُطل في النظام قبل أن تتلقى الجهة المشترية العطاء

It was explained that the paragraph was important because it provided protection to the procuring entity from unjustifiable protests and, at the same time, safeguarded against an unjustifiable cancellation of the procurement proceedings by the procuring entity.

وعُلل ذلك بأن الفقرة مهمة لأنها توفر حماية للجهة المشترية من الاحتجاجات التي لا مبرر لها، وتُوفر في الوقت نفسه ضمانا من إلغاء إجراءات الاشتراء دون مبرر من جانب الجهة المشترية

Some participants might decide not to participate further in negotiations, or they might be excluded from further negotiations by the procuring entity if they were considered to be unable to respond to the needs of the procuring entity..

وقد يقرر بعض المشاركين عدم المضي في المشاركة في المفاوضات، أو قد تستبعدهم الجهة المشترية من المضي فيها إذا رأت أنهم غير قادرين على تلبية احتياجاتها

With reference to paragraph 25, the point was made that it might be burdensome for the independent body to review all documents related to the procurement proceedings transferred to it by the procuring entity as required under article 66(8) of the draft Model Law.

وفي معرض الإشارة إلى الفقرة 25، ذُكر أنه قد يشقّ على الهيئة المستقلة مراجعة جميع الوثائق المتصلة بإجراءات الاشتراء التي تحيلها إليها الجهة المشترية وفق ما هو مطلوب بمقتضى المادة 66(8) من مشروع القانون النموذجي

As a result, article 13 of the 2011 Model Law[**hyperlink**] regulates the language(s) of all documents in the procurement proceedings, regardless of whether the documents are prepared by the procuring entity or by suppliers or contractors.

Where applicable, the procurement regulations should refer to any law of the enacting State that prohibits the acceptance by the procuring entity of the tender security that is not issued by an issuer in the enacting State.
