Mr. Pham Quang Vinh( Viet Nam): It is a pleasure for me to address the plenary on the important agenda item“ Oceans and the law of the sea” as the General Assembly considers developments pertaining to the implementation of the United Nations Convention on the Law of the Sea and other developments and issues relating to ocean affairs and the law of the sea.
UNCTAD should keep under review and monitor developments pertaining to legal and regulatory aspects of electronic commerce and keep countries informed thereof, particularly on the following questions: jurisdiction, applicable law, dispute resolution mechanisms,
(a) To review developments pertaining to the promotion and protection of human rights and fundamental freedoms of indigenous peoples, including information requested by the SecretaryGeneral to analyse such materials, and to submit its conclusions to the SubCommission, bearing in mind the report of the Special Rapporteur of the Sub-Commission, Mr. José R. Martínez Cobo(E/CN.4/Sub.2/1986/7 and Add.1-4, the two final chapters being issued as a United Nations publication, Sales No. E. 86. XIV.3);
In its resolution 2003/58, the Commission on Human Rights invited the Working Group to take into account in its deliberations on developments pertaining to the promotion and protection of the human rights of indigenous peoples the work, within the framework of their respective mandates of the Permanent Forum on Indigenous Issues, all thematic special rapporteurs, special representatives, independent experts, working groups and expert seminars as it pertains to the situation of indigenous people.(b) Principal theme:" Indigenous peoples and globalization".

The mandate of the Working Group, the organization recalled, was to review developments pertaining to the human rights of indigenous populations and to develop standards concerning the protection of indigenous rights. The mandate of the Permanent Forum, the organization noted, was to provide expert advice and recommendations on indigenous issues to the Economic and Social Council, as well as programmes, funds and agencies of the United Nations through the Council, and to prepare and disseminate information on indigenous issues.

What conclusions can be drawn from the analysis of developments pertaining to the death penalty in the light of the prohibition of cruel, inhuman and degrading treatment? In principle, the answer to the legal question posed by the French delegate in the General Assembly depends on the interpretation of the words" cruel, inhuman or degrading treatment or punishment" in article 7 of the International Covenant on Civil and Political Rights and similar provisions in other international and regional human rights treaties.
