Principle 12 states:" As everyone is allowed to participate in lawful and peaceful assemblies, in accordance with the principles embodied in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, Governments and law enforcement agencies and officials shall recognize that force and firearms may be used only in accordance with principles 13 and 14.".

وتنص المادة 12 أنه" لما كان من حق كل فرد الاشتراك في تجمعات مشروعة وسلمية طبقا للمبادئ الواردة في الإعلان العالمي لحقوق الإنسان والعهد الدولي الخاص بالحقوق المدنية والسياسية، ينبغي للحكومات وللهيئات التي يناط بها إنفاذ القوانين والموظفين المكلفين بإنفاذها التسليم بأنه" لا يجوز استخدام القوة والأسلحة النارية إلا طبقا لما هو وارد في المبدأين 13 و 14

For this purpose the Sub-Commission requested the Office of the High Commissioner" to seek the views of the States concerned and interested non-governmental organizations, and to gather all available information about existing obstacles to effective enjoyment of the human rights and fundamental freedoms embodied in the Universal Declaration of Human Rights and about obstacles to ratification of the Covenants and the measures being taken by States to remove them".

ولتحقيق ذلك ترجو اللجنة الفرعية من المفوضية" أن تلتمس،[…] آراء الدول المعنية والمنظمات غير الحكومية المهتمة بالأمر، وأن تقوم بجمع كافة المعلومات المتاحة عن العقبات القائمة التي تعترض سبيل التمتع الفعال بحقوق الإنسان والحريات الأساسية المجسدة في الإعلان العالمي وعن العقبات التي تعترض التصديق على العهدين والتدابير التي تتخذها الدول من أجل تذليلها

The aim of the mechanism described below is to encourage efforts to observe the human rights and fundamental freedoms contained in the Universal Declaration by States which are not parties to the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights and a number of other conventions that place upon States the obligation to observe the particular rights embodied in the Universal Declaration.

يتمثل الهدف من الآلية الوارد وصفها أدناه في تشجيع الجهود الرامية إلى مراعاة حقوق الإنسان والحريات الأساسية الواردة في الإعلان العالمي من جانب الدول غير الأطراف في العهد الدولي الخاص بالحقوق المدنية والسياسية، والعهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية وفي عدد من الاتفاقيات الأخرى التي تحمل الدول التزاما بمراعاة حقوق معينة واردة في الإعلان العالمي

Finally, it must be stressed that the participants in the World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance at Durban recalled that" the dissemination of all ideas based upon racial superiority or hatred shall be declared an offence punishable by law with due regard to the principles embodied in the Universal Declaration of Human Rights and the rights expressly set forth in article 5 of the International Convention on the Elimination of All Forms of Racial Discrimination".

All acts and omissions of state representatives that constitute a violation of the general recognition of the right to life embodied in the Universal Declaration of Human Rights( article 3) and the International Covenant on Civil and Political Rights( article 6 and, also, articles 2, 4, para. 2, 26 and, in particular with regard to the death penalty, articles 14 and 15), as well as a number of other treaties, resolutions, conventions and declarations adopted by competent United Nations bodies, fall within his mandate.
